Abstract

This paper summarizes Canadian law pertaining to defamation and looks at the educational cases in this area. The definition of defamation is explored generally, then the areas of defamation, libel, and slander are studied. Two related matters are examined: the importance of publication and the role of malice. Finally, the various defences available to a defendant in a suit of defamation are studied. Wherever educational cases are available, they are elaborated on and tied in to appropriate areas to explain the law of defamation as it relates to education.
