Selon l’auteur, la non-discrimination ne constitue une protection quasi-absolue que dans quelques domaines (comme le sexe et la race), alors que c’est un facteur beaucoup moins important dans d’autres. On devra établir des systèmes répressifs et peut-être exiger des ressources supplémentaires des niveaux supérieurs du gouvernement avant de pouvoir assurer une chance égale à tous. On pourra juger du succès de nos entreprises d’après la similitude des situations des gens, mais c’est là une optique des plus généralistes. On met en lumière les limites probables des tribunaux en tant qu’organes répressifs, par rapport aux nouvelles possibilités implicites dans la Charte au niveau de l’égalité des chances.
